Ed’s practice falls into two categories: litigation and advising.

In litigation, Ed has won jury trials, bench trials, and arbitrations, representing both plaintiffs and defendants. Most of his cases involve real-estate/property, business, or consumer-protection issues. He does not hesitate to bring cases to trial if necessary, and he generally tries three to four cases a year. Based on peer reviews, Best Lawyers recognized Ed as Wichita’s 2023 Lawyer of the Year for Real Estate Litigation.

As a natural outgrowth of his litigation practice, Ed regularly assists clients and other lawyers in the collection of non-consumer judgments (he does not collect or attempt to collect consumer debts). He has significant experience in the identification, seizure, and disposition of assets to satisfy judgments that are not voluntarily paid.

In advising, Ed advises Kansas businesses on day-to-day matters with an emphasis on minimizing litigation and regulatory exposure. He also advises clients who are purchasing or selling real estate.

Ed’s practice focuses on real-estate/property, business, and consumer-protection matters. He represents both plaintiffs and defendants and has extensive experience in jury trials, bench trials, and arbitrations. Based on peer reviews, Best Lawyers recognized Ed as Wichita’s 2023 Lawyer of the Year for Real Estate Litigation. In addition to his litigation practice, Ed advises several Kansas businesses on day-to-day matters with an emphasis on minimizing litigation and regulatory exposure. He also represents both buyers and sellers in real-estate transactions.

Notable Cases

Counsel for home buyers in First American Title Insurance Company v. McGonigle, a federal lawsuit involving sellers’ failure to disclose that a pond on rural residential property was contained by a state-regulated dam. Following a trial to the bench, the court found in plaintiffs’ favor and awarded damages of more than $200,000 and attorney fees.
Counsel for the defendant in lawsuit for partition of real property. Following a trial to the bench, the court agreed with defendant’s proposed division of the property and awarded attorney fees.
Counsel for owner of classic car in action against car-restoration company for violations of the Kansas Consumer Protection Act. Following a trial to the bench, the court found multiple violations of the Act and awarded damages and attorney fees.
Counsel for the defendant in lawsuit involving allegations of civil embezzlement. In a trial to the bench, the court dismissed plaintiff’s lawsuit at the close of its case without defendant having to present any evidence.
Counsel for plaintiffs in malicious-prosecution lawsuit against contractor and its attorney. Following a trial to the bench, the court found the contractor’s attorney had engaged in malicious prosecution and had violated the Kansas Consumer Protection Act. The court awarded damages, civil penalties, and attorney fees.
Counsel for the defendant in lawsuit for trespass and reformation of deed to real property. Following a trial to the bench, plaintiff was awarded less than two percent of his claimed damages.
Counsel for the plaintiff in lawsuit involving defective construction of hotel. Case resolved on favorable terms before trial.
Counsel for plaintiff-business in lawsuit against former contractor for breach of contract and tortious interference. Following a jury trial, the jury rendered a verdict in favor of the plaintiff and awarded damages.
Counsel for defendant-landlord in lawsuit by former tenant for actual, statutory, and punitive damages. Following a trial to the bench, the court found the tenant had sustained no damages and entered judgment in favor of the landlord.
Counsel for plaintiff in lawsuit against trust company for breach of contract and violation of the Kansas Consumer Protection Act. Following a jury trial, the jury rendered a verdict in favor of the plaintiff on multiple consumer-protection violations.
